Also, I am not satisfied with the absolute non-cooperation of the wrongful death Attorneys in the New York State I found. If you know a decent Attorney who is willing to be paid on a contingency basis, I have a case here and I wish to do justice to Ash OR DIE.

McHugh, ***Important note: please know all the proofs will be send to your Washington, D.C. office a.s.a.p., Sir. Thank you *** Please allow me to ask for a specific request for My Ashley. I would like to know what the officials of the Department of Veteran affairs can do about what happened to him so I am trying to summarize below from my thirty-five (35) pages document. By the way, Ashley told me about the middle of November the 8th floor of the Albany VA Medical Center is under investigation - this is giving you an indication even if what we lived seems unbelievable, we really experienced it. Like there is a old French saying: “There is no smoke without fire”. VA Hospitals: I remember you communicated with the officials of the Department of Veterans administration explaining the type of care he received at the Albany VA Medical Center. Thank you very much for that initiative, Mr. McHugh. From the proofs I was able to get, Ashley first asked for help for liver problems at the VA PCC-Silver-Halasy Clinic in North Carolina at least on August 31st, 2004 (the date of the letter sent to him from their office) and at the Massena VA office at least in June 2005 (please check the happy birthday card sent by the Albany VA Healthcare Network Upstate, NY on Smith road so it has to be in 2005) so I have absolutely all the reasons to believe that if the right thing would be done i.e. put Ashley on a liver transplant list, he would be alive today - if of course, they would really have the expertise based on several years of practice to do a liver transplant I should add from my experience at the Albany VA Medical Center I will summarize below. There was a huge difference of his condition before going to this VA hospital and after. 1- Ashley never had to take lactulose at home before his time at the Albany VA Medical Center; 2- He never had a high level of ammonia in his system at home; 3- He never told incoherent things before due to the ammonia going straight to his brain instead of being treated by his liver first. Never. (This is called encephalopathy (brain disease) caused by accumulation of excess of ammonia). To see a very intelligent man (even being a member of the prestigious Who’s Who) in this state was heartbreaking to say the least but I understood quick it was a temporary state; 4- Ashley went at the ICU with an ammonia level of 393 because I wasn’t heard. This is called: hepatic coma and this coma followed the encephalopathy. I observed during the afternoon and the evening the encephalopathy Ashley was experiencing – Dr. James County who was supposed to check his ammonia level told me in the afternoon that Ashley was feeling fine. (and that’s why I asked the help of Lori Bobersky right after) I asked repeatedly to check his ammonia level on the Veteran’s day like the doctor was supposed to do it in Saturday morning November 11th and I asked repeatedly the nurse between 7:00 – 10:00 p.m. to take care of Ashley and unfortunately, Dr. Susan Rhee who is usually giving an excellent service forgot to come when the nurse paged her at the nurse station. (There is good doctors and nurses but they aren’t enough to really do a difference, at least at the Albany VA Medical Center) I asked Lori Bobersky the social worker to come see Ashley in the afternoon because he did something very unusual, to stick a piece of gum inside a new newspaper – I known from that behavior the ammonia was going straight to his brain because it wasn’t totally “himself” (because of the encephalopathy). Ashley replied to her he was tired and she “bought” that even if I told her I already saw may times Ashley tired and he never had an irrational behavior like this even with an extreme fatigue. Something has to be deadly wrong…. All Ashley was able to do is sit on his bed and to hold his head with his two hands bend his head and close his eyes – of course he wasn’t able to ask for help in this state!!! The day after, another doctor called me at the Fisher House (located in the front of the Hospital) at 10:15 a.m. to tell me Ashley was at the ICU in the coma. At the ICU, Dr. Timofeev Stan was telling me that my husband didn’t take his lactalose (he refused it but like I said he wasn’t totally himself with all this ammonia going directly to his brain) but he didn’t know what happened on Saturday morning so I filled him about the fact Dr. James County didn’t check his ammonia level even if he was supposed to because Ashley had an ammonia peak on Thursday November 9th – the ammonia level was at 140 and because Dr. Susan Rhee heard me, she checked it and prescribed the lactalose so his ammonia level was at 100 after the treatment (the ammonia level of most people is about 20) but since he was at that point, they were supposed to check it on Saturday morning. If Ashley known his ammonia level was high, he would be scared and would take his lactulose. One nurse at the ICU wanted to give Ashley Morphine (again !!!!!) when he had a Gastric Reflax. Even if I told her Ashley could surely have serious problems if he would take Morphine, she came back saying to Ash: “you are refusing to take Morphine” and I replied: “he is not refusing to take Morphine, he know fully well he would have serious problems and most likely die” if he would take it, especially after this ammonia peak level at 393 and going to an hepatic coma. After 30 minutes of research for a painkiller because I wanted something better for Ash than Morphine they finally found the fentanyl and that’s why I know and found they could give him this painkiller when they did the “¾ inch tube procedure”. I am totally and entirely sure Mr. McHugh the Albany VA Medical Center are the ones who trashed his liver and that's why the ammonia began to be totally out of control after a while at the Albany VA Medical Center. Not before. That never had been the case at home. (Anyway, the VA office in North Carolina and the VA Hospital in Syracuse is entirely responsible for not putting Ashley on a liver transplant list and even the Albany VA Medical Center were only considering the possibility of putting him on this list towards the end of his hospitalization - it is what they said to him) Here is why: 1) Surgery without a painkiller - a real torture. ¾ inch tube inserted in his body passing inside his belly, his lungs and finishing near his neck on Oct 19th, 2006 about 11:15 p.m. – not only I know I truly can believe Ashley’s words (he was an upright man) but also Dr. Ming Fey Luo told me also my husband had this intervention without a painkiller. They could at least find the fentanyl if they would do their “homework”. Of course, Ashley wanted to have this surgery because between the request for Ashley on Oct. 17th 2006 to go at the Albany Hospital (we were at the Massena Memorial Hospital through the VA office since the beginning of the day of Oct. 16th) and also Ashley had to wait until Oct 19th about 11:15 p.m. to get this procedure done he had the time to suffocate twice with all this liquid in his lungs Sir so for sure he was more than ready for this surgery and it’s not something you should worry about when you are in a hospital if they would give you a painkiller…or not. 2) They offered to diminish his pain after the “surgery” without telling him they were about to give him Morphine. He trusted they knew what they were doing; but after the fifth shot he asked what they were giving him and they told him it was Morphine which he did not want but it was too late. Ashley’s ammonia level went straight to the roof about 200 and was intoxicated for 4-5 hours, repeating “2-4-6” or “4-2-6” when asked any questions. It is all he was able to speak for hours; it also appeared to me he had been put into an opioid trance or overdose on the top of the ammonia problem. I believe the combinaison of the two incidents mentioned above (1 + 2) put him in a situation he would surely be psychologically weaker and wouldn't think about the kind of help they were about to give him. (Morphine) (I have a Master degree in Psychology from Canada) Of course, he wanted a relief of his excruciating pain…who, with a right mind wouldn’t want that? 3) The hospital fed him large quantities of proteins such as meat Ash began to be yellow exactly on Nov. 26th, 2006, 4 days after the Albany VA Medical Center released him, he was crashing and was carried by ambulance at the Massena Memorial Hospital on Nov. 28th, 2006 about 5:00 p.m. and died on Dec. 5th, 2006...... His liver was worse than ever before and that caused a sequence of physical breakdowns that would ultimately cause his death. (liver shut down, kidneys shut down, lungs shut down and cardiopulmonary arrest) I wanted so bad Ashley to have a liver transplant before his kidneys would totally shut down…but it was too late. (I first thought the change in his color was my imagination because this apartment doesn’t have enough light in.) Sir, I don’t know exactly what trashed Ashley’s liver, I don’t wish to pretend to be a liver specialist but I believe the large amounts of proteins from meat did “the job”. The husband of my sister in law, Anne Buchanan Green has a liver problem too and he has to be on a low protein diet – this is a must. Ashley thought his liver condition was better than Merk (he had not been offered services to diagnose his nagging health problems; no one even mentioned getting on a liver transplant list like Merk) in fact, it was the opposite….Here is from a relevant source of informations: “This does not mean, however, that eating a diet containing enormous amounts of protein is the answer. In fact, it is unhealthy. Excess protein puts undue stress on the kidneys and the liver, which are faced with processing the waste products of protein metabolism. Nearly half of the amino acids in dietary protein are transformed into glucose by the liver and utilized to provide needed energy to the cells. This process results in a waste product, ammonia. Ammonia is toxic to the body, so the body protects itself by having the liver turn the ammonia into a much less toxic compound, urea, which is then carried through the bloodstream, filtered out by the kidneys, and excreted. As long as protein intake is not too great and the liver is working properly, ammonia is neutralized almost as soon as it is produced, so it does no harm. However, if there is too much ammonia for the liver to cope with—as a result of too much protein consumption, poor digestion, and /or a defect in liver function—toxic levels may accumulate. Strenuous exercise also tends to promote the accumulation of excess ammonia. This may put a person at risk for serious health problems, including encephalopathy (brain disease) or hepatic coma. Abnormally high levels of urea can also cause problems, including inflamed kidneys and back pain. Therefore, it is not the quantity but the quality of protein in the diet that is important (see DIET AND NUTRITION in Part One)”. Source: http://www.vitamins-source.com/AminoAcids/ The Albany VA Medical Center put Ashley on a low protein diet (a sudden change of mind) at the end of his hospitalization when it was too late i.e. when his ammonia level in his body was just totally out of control. The Strong Memorial Hospital in Rochester, NY (not a VA Hospital) The lady at family services in the Massena Memorial Hospital (I don’t have her name) offered us the possibility of a liver transplant from the The Strong Memorial Hospital and she even called back Meredith Grey at: (518) 275-6018 with my offer to pay for everything. The Strong Memorial Hospital finally cancelled it, she said to me December 5th in the afternoon. My point is: if the Massena Memorial Hospital doctor, Mr. Nimesh Desai and the nurses believed there was absolutely no hope for Ashley at that point, why the family services lady offered a liver transplant to Ashley?!? They are supposed to work as a team, right? Why to give this hope if there would be no hope?!? In conclusion about the VA hospitals, my husband suffered a lot before dying and I am standing as long as I am alive to tell the truth about the way he died. In a letter to To Christopher H. Lowery, VA Patient Advocate dated on Thu, 16 Nov 2006 21:43:29 -0500 (EST) I concluded this: “I am truly scared to leave to go back to Massena for just a couple of days to take care of what could ease Ashley’s mind (and coming back to Albany right after) simply because of what happened. Most folks are dying before reaching a 393 ammonia level”. I don’t know exactly what can be done by the officials of the Department of Veteran Affairs Sir and if possible I would really love to know what they wish to do further to your communication with them before December 4th, 2006 – I am exposing you my request for this wonderful man – a genius (member of the who’s who and more….) who had a heart of Gold, a Godly man. This is the biggest loss of my life. We did everything together, including co-working, collaborating together. Our personality and our abilities were working very, very well together and I know I can not replace Ashley M. Buchanan because he was a so special person. Green card: Please allow me to ask a request for myself if you please can do something and the main problem behind all the consequences I am actually facing in the U.S. is directly in relation with Immigration. I wish to provide you a proof of what I am about to tell you Mr. McHugh because it sounds unbelievable so I’ll make sure to include a paper copy of the proof with this letter. What I should tell you from the start is the fact Ashley had to prove to the Immigration he was a U.S. Citizen at the end of June 2005 and they were sitting on my case until they will get the copy of the passport they were asking for but fact is they were refusing Ash’s birth certificate but for getting the passport, it was based on providing the birth certificate to the passport guys so thank God, the passport guys were not having the same problem than Immigration guys. We had to wait on the U.S. passport process and this was totally unnecessary simply because when you were born on a U.S. Army Base like my husband was you are automatically a U.S. Citizen and when you served in the U.S. Navy like my husband did you are automatically a U.S. Citizen so that was pretty mean to let pend the Immigration process until Ashley will get the passport based anyway on the birth certificate !! Ashley submitted the Immigration forms on March 18th, 2005 and they made him wait exactly 2 ½ months to tell him now he should get a U.S. passport to prove he was a U.S. Citizen. Ashley was most definitively a U.S. Citizen and I sincerely don’t know what they problem is. If a U.S. Citizen is treated this way by Immigration, then please consider the Immigrant actually writing to you could have “administrative” issues with them….easily. In brief, I can not work, I can not get a non-driver ID card for the bank, I can not pay the bills by checks, I can not get Ash’s car, I can not learn to drive and finally I can not get a driver license…without this green card. I am in a fix in the U.S. and I truly don’t want to leave for now – after all, my Visa is good for a year according to what is written on my Visa so until June 8th, 2007 – because I need bad to mourn in the Pine Grove Cimetery. Here are the administrative type of problems I am actually experiencing: At the borders, I got problems and more precisely I should add I was harassed. The first thing they told me is my Visa was expired so I thought they wouldn’t even let me bury my husband (I am truly honored to take care of everything related to it) and at least recover his belongings in our apartment. (I am paying the bills since Ashley was sick by U.S. Money Orders) This happened at the Fort Covington POE and I had three witnesses: Merk & Anne Green (Ash’s sister and his brother in law) and Stephen Buchanan. (his son) There is an expiration date on my Visa and it was Dec. 7th, 2006 and Ashley and I worried about this three months ago and we went at the Roosevelt POE. The top Immigration guy there (I don’t’ have his name) explained to us it as my limit to enter in the U.S. but my temporary permanent residence is good for a year like it is written on my Visa. Back to Fort Covington POE, when I told to this man who was telling me my time was expired in the U.S. that the Congressman John M. McHugh knows perfectly my situation and from that point his attitude changed. This happened on December 10th, 2006 about 4:30 p.m. You know how hard my Ashley worked to make me enter legally….. Now that’s the Department of Motor Vehicle but it is related to my Immigration administrative problems. Immigration issued me a green card 2 months ago, I am still waiting now with what just happened at Fort Covington POE, I don’t necessarily want to enter in communication with them to find out what’s going on with this green card without mentioning I already called them about 3 months ago and they told me my green card wasn’t issued at that time and they will send me a letter explaining what’s going on and that letter never came. I know they issued a green card 2 months ago because the Department of Motor Vehicle just called the Immigration office and I am not sure it is the Albany one but if my memory is good, it is the Albany Immigration office. Is it possible to erase the expired date of Dec. 7th 2006 on my Visa because it is confusing everybody? – except you and the “top” Immigration guy at Roosevelt POE? The problem is I cannot transfer Ashley’s car to my name even if I have a Notary Public State of New York, Marci M. Ackerman who signed the affidavit for transfer of motor vehicle because I don’t have this green card. VA Office rules in Massena: Because of VA rules like Ashley should call them before going to the emergency even if he was very weak – his arms and legs were even shacking and was yellow all over – the rule is to wait another business day to call them before going to emergency because their office was closed at 4:00 p.m. and it was about 5:00 p.m. when I called the ambulance. I wasn’t willing to wait an extra day with my husband in this condition – he was feeling so bad he couldn’t even sign his admission papers, I had to sign them, otherwise he wouldn’t be admitted at the emergency at the Massena Memorial Hospital…Ashley didn’t want to go back to a VA Hospital (and I understand him perfectly about this because it is me who encouraged him to take the “first offer of exit door available”) and that’s why he waited that long. I had to do something. I must also add that the reason why I waited from Nov. 26th to Nov. 28th, is I was afraid Ash would be back to a VA hospital also (yes, we were both very scared) and I was trying my very best to help him like to give him a triple dose of lactulose like they did at the ICU of the Albany VA Medical Center to decrease the ammonia level in his body and it seemed to work on Nov. 27th but not on Nov. 28th so I had to realize something else was going on and now I know what it was - it was his liver on the way to totally shut down and that’s why he was yellow. With 881 $ per month for 2 persons since June 16th, 2006 – a single pension not adjusted by the VA yet and Ashley never received the retro payment from the date of our marriage on Oct. 29th 2004 to now his death on Dec. 5th, 2006, this wasn’t really a sinecure for us and I contacted the American Legion in Canton to enter in communication with the Veteran administration because I can not get the 881$ per month anymore because it was for Ashley when he was living without me (forced partition) and when I was living with him. (reunification) We were so afraid of the VA hospitals and that’s why we were not very quick to call the VA Office before going to the emergency so we waited 2 extra days to finally not have the choice to call the ambulance and go straight to the emergency because Ashley was feeling pretty bad. So the VA won’t take the last bills even if it was a matter of life and death and the VA Office was closed when I called the ambulance at 5:00 p.m. because they are closing at 4:00 p.m. Because the Department of Motor Vehicle is waiting for a green card not coming, I can not even do transactions at the bank Sir because I only have 1 ID card, the SSC because nobody wish to consider my Visa, except to deposit in Ashley’s bank account but I won’t be able to pay the bills this way anymore, I can not even use this account opened to both names to make checks – I pay cash or by money orders I am buying at the U.S. Post office. I really have a problem and I don’t wish to go back to Canada because I badly need to mourn Ashley for a while in Massena – that is my biggest need. Oh yes, I can not even get the non-driver ID card at the Dept of Motor Vehicle to help me with the bank business because they are waiting for this the green card also for this non-driver ID card. For Ashley’s sister, Anne: And finally, I have a special request for Ashley’s buddy since they are teenagers, Merk Green, the husband of Ashley’s sister. Ashley’s kidneys were totally and entirely shut down. There was absolutely no hope for a liver transplant for him when the help from the Georgetown University Hospital was made available to you, could you please transfer this favor to Merk Green? Merk is waiting since about 2 years to have a liver transplant and I don’t wish Ash’s sister to pass through the same horrible event than me. I would love for them to have this privilege transferred, Mr. McHugh if possible. Contrary to Ash, Merk is on a liver transplant list but I told Merk at Ashley’s funerals I will do the request for him because once the liver is totally shut down, I know by experience the death is following….too much quickly.
